Colorado: Bill amending CPA to address biological data passes third reading in Senate

On March 26, 2024, House Bill 24-1058 on Protect Privacy of Biological Data passed its third reading in the Colorado State Senate. This follows its amendments made by the Senate Committee on Business, Labor, & Technology on March 21, 2024, and its passage by the Colorado House of Representatives on February 9, 2024. The bill will now be sent to the Governor of Colorado for signature.

In particular, the bill provides new definitions for 'sensitive data' to include biological data and neural data, and expands the definition of biological data.

Following the amendments to the bill, 'biological data' is defined as 'data generated by the technological processing, measurement, or analysis of an individual's biological, genetic, biochemical, physiological, or neural properties, compositions, or activities or of an individual's body or bodily functions, which data is used or intended to be used, singly or in combination with other personal data, for identification purposes.'

While 'neural data' is defined as 'information that is generated by the measurement of the activity of an individual's central or peripheral nervous systems and that can be processed by or with the assistance of a device.'
