Tasmania

Summary

Law: Personal Information Protection Act 2004 (No. 46 of 2004) ('the Act'). Please note that the Act only applies to public bodies. Private organisations are subject to the federal Privacy Act 1988.

Regulator: The Office of the Ombudsman ('the Ombudsman')

Summary: There is no separate, territorial level private sector data protection law in Tasmania. The Act regulates data protection related to the public sector and the Ombudsman ensures compliance with the Act. However, the Ombudsman has released guidance that generally addresses both the Act and the federal Privacy Act 1988 and considers personal data protection in broad terms. There is no separate health sector related legislation that only applies in Tasmania, although the Act applies to public sector health services.
