International: Council of the EU approves protocol with Japan to facilitate cross-border data flows

On April 29, 2024, the Council of the European Union adopted its decision to include provisions on cross-border data flows between the EU and Japan in its agreement for an economic partnership.

According to the Council, the protocol would provide greater legal certainty, ensure that data flows between the EU and Japan will not be hampered by data localization measures, and enable companies to handle data without administrative or storage requirements.

Next steps

The agreement can enter into force after it has been ratified by Japan and both the EU and Japan have notified each other of the completion of their internal procedures.
