Colorado: Governor signs bill amending CPA to address biological data into law

On April 17, 2024, the Colorado Governor signed House Bill 24-1058 on Protect Privacy of Biological Data into law. The Act now amends the Colorado Privacy Act (CPA) by expanding the definition of 'sensitive data' to include biological data. In particular, the Act defines biological data as data that characterizes the biological, genetic, biochemical, or physiological properties, compositions, or activities of an individual's body or bodily functions. Under the Act, biological data also includes neural data, defined as the activity of an individual's central nervous system or peripheral nervous system that can be processed by or with the assistance of a device.
