Zimbabwe: MISA Zimbabwe highlights need for robust data protection framework in deployment of ICT

The Media Institute of Southern Africa Zimbabwe ('MISA Zimbabwe') announced, on 3 March 2021, that, further to the launch of the National Data Centre in Zimbabwe for the deployment of ICT at the government level, there is a need for a robust cybersecurity and data protection framework. In particular, MISA Zimbabwe noted that data protection provisions should clarify how data is collected and shared and how government agencies will have access to said data, as well as that legislation, policies and guidelines must be adopted to guide the acquisition, transfer, and storage of data in Zimbabwe. In addition, MISA Zimbabwe expressed criticism towards the Cybersecurity and Data Protection Bill ('the Bill') arguing that it fails to provide for data subject rights and data retention periods. Further to this, MISA Zimbabwe urged more transparency on the nature of data that will be under the control of the National Data Centre as well as stating that any sharing of data with third parties should occur in accordance with the law and for the fulfilment of a legitimate purpose. Furthermore, MISA Zimbabwe recommended that the discussions on the Bill be guided by the African Union Convention on Cybercrime and Data Protection.
