Washington: Bill creating a charter of personal data rights introduced to Legislature

Senate Bill 5643 creating a charter of people's personal data rights was introduced, on 31 January 2023, to the Washington Senate and thereafter referred to the Committee on Environment, Energy & Technology. In particular, the bill defines terms, including biometric data, captured personal information, covered entity, data processor, and targeted advertisements, among other things, and provides individuals residing in Washington State with rights, including a right to know, access, object, correct, and delete.

In addition, the bill stipulates requirements for a privacy policy that must be provided by covered entities, including both a long and a short-form privacy policy that is persistently and conspicuously available. Furthermore, the bill clarifies that individuals aged 13 and older will be deemed competent to exercise all rights granted to individuals. Notably, the bill provides specific requirements associated with biometric information, including the collection, disclosure, processing, deletion, and retention of such information.

Finally, the bill is a companion bill to House Bill 1616, which has been introduced to the Washington House of Representatives.
