Thuringia: TLfDI publishes statement on EU AI Act and GDPR

On February 28, 2024, Thuringian data protection authority (TLfDI) published a statement on the Proposal for a Regulation of the European Parliament and of the Council Laying Down Harmonised Rules on Artificial Intelligence (the AI Act) and the General Data Protection Regulation (GDPR). The statement highlights the continued applicability of the GDPR to artificial intelligence (AI) systems and states that the obligations of the GDPR and the rights of those affected remain unchanged.

Additionally, according to the TLfDI, the AI Act goes beyond the GDPR in certain areas and the transparency obligations under the GDPR are not replaced but expanded under the AI Act. Additionally, the TLfDI noted that an AI Act-certified or tested system would not automatically be considered as compliant with the data protection regulations.
