Romania: Ministry of Justice launches consultation on whistleblowing draft law

The Ministry of Justice published, on 4 March 2021, for public consultation, a draft law transposing the Directive on the Protection of Persons who Report Breaches of Union Law (Directive (EU) 2019/1937) ('the Whistleblowing Directive') alongside an explanatory report on the same. In particular, the Ministry highlighted in its explanatory report that the scope of the draft law is more extensive compared to the Whistleblowing Directive as it covers, among other things, reports of non-compliance with deontological and professional norms, as well as extending protection under the whistleblowing law to more individuals. In addition, the Ministry noted that the draft law addresses, among other things, internal and external reporting channels, sanctions for retaliation against whistleblowers, as well as the protection of personal data and privacy in the detection and prevention of infringements.

The draft law is currently under public consultation for 20 days after the date of its publication and will be submitted to the government for adoption. Comments can be submitted via email to [email protected].
