Ontario: IPC submits comments on proposed regulation under PHIPA

The Information and Privacy Commissioner of Ontario ('IPC') published, on 9 November 2022, its comments on the Proposed Regulation No. 22-HLTC027 under the Personal Health Information Protection Act, 2004 ('PHIPA'), relating to the right of access to records of personal health information in electronic format. In particular, the IPC outlined its proposed amendments, which include:

  • requiring Ontario Health to consult with the IPC and the public;
  • keeping the requirement to provide access to records in PDF until there is an equally commonly used alternative format available that has been specified by Ontario Health; and
  • improving drafting consistency with the provisions of existing regulations to the PHIPA.
