New York: Bill on health information privacy referred to Science and Technology Committee

On January 3, 2024, Assembly Bill 4983 for an Act to amend the general business law, in relation to privacy standards for electronic health products and services and permissible data brokering was reintroduced and referred to the Science and Technology Committee, following amendments made to the bill on June 5, 2023.

In particular, the bill establishes conditions for organizations to engage in data processing, geofencing, or data brokering activities. Additionally, the bill prohibits, among other things, the sale of an individual's regulated health information to a third party.
