Netherlands: AP publishes plan for 2024

On December 21, 2023, the Dutch data protection authority (AP) published the AP's annual plan for 2024. In particular, the plan outlines that the AP will focus on five areas, including algorithms and artificial intelligence (AI), Big Tech, freedom and security, data trading, and digital government. Regarding algorithms and AI specifically, the plan highlights the AP will:

  • prioritize complaints, data breaches, and investigations about algorithms and AI;
  • publish a report twice a year on algorithm risks in the Netherlands; and
  • publish best practices about how algorithms can be used responsibly.

On Big Tech, the Plan notes that the AP will:

  • prioritize the handling of complaints regarding large technology companies;
  • work together with other European regulators to ensure that large tech companies only develop and offer generative AI models that are compliant; and
  • work together with other European regulators to offer innovative supervision of Big Tech.
