Kenya: 2021 Draft Regulations published and await National Assembly approval
The Office of the Data Protection Commission ('ODPC') announced on Twitter, on 14 January 2022, the 2021 Data Protection Regulations have been published, following a notice of the same in the Official Gazette. In particular, the Regulations were first put forward for public consultation on 13 April 2021 with comments accepted until 11 May 2021. In this regard, the Regulations are now awaiting approval from the National Assembly, after which, provided no objections are made, the Regulations will come into effect. Notably, the National Assembly has 28 days from the day the Regulations are referred to it to approve or object to the Regulations.
Notably, the Regulations comprise of the following three regulations:
- the Data Protection (General) Regulations, 2021;
- the Data Protection (Complaints Handling and Enforcement Procedures) Regulations, 2021; and
- the Data Protection (Registration of Data Controllers and Data Processors) Regulations, 2021.
