Germany: DSK updates TTDSG guidance

The German Data Protection Conference ('DSK') published, on 30 November 2022, an updated version of its guidance on the Federal Act on the Regulation of Data Protection and Privacy in Telecommunications and Telemedia ('TTDSG'), which was first published in December 2021. In particular, compared to the initial version, the updated guidance also addresses, among other things:

  • the validity of consent;
  • the legality of processing according to Articles 6(1)(c) and 6(1)(e) of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR');
  • transfers of personal data to third countries;
  • the design of consent banners; and
  • data subjects' rights, specifically those laid down by Articles 13, 15, and 17(1) of the GDPR.
