Colorado: Amended biometric privacy bill introduced to Senate

On February 23, 2024, House Bill 24-1130 for an Act concerning protecting the privacy of an individual's biometric data was introduced to the Colorado Senate, and thereafter assigned, on the same date, to the Senate Judiciary Committee. If enacted, the amended bill will amend the Colorado Privacy Act (CPA) to add protections for biometric data.  

The amended bill will require a data controller to, among other things, adopt written policies that:  

  • establish retention schedules for biometric identifiers; 

  • include protocols for responding to breaches of data that contain biometric identifiers or biometric data; and  

  • introduce guidelines that require the permanent destruction of biometric identifiers by certain dates.
