Brazil: ANPD publishes guide on LGPD compliance in elections
The Brazilian data protection authority ('ANPD') announced, on 3 January 2022, the release of a guide with practical guidance on actions related to the processing of personal data by candidates, political parties, and coalitions during elections, and is also seeking comments on the same. In particular, the guide provides practical guidelines on the application of Law No. 13.709 of 14 August 2018, the General Personal Data Protection Law (as amended by Law No. 13.853 of 8 July 2019) ('LGPD') in the 2022 elections, clarifies the mandatory aspects of the LGPD in the electoral context, and provides recommendations and best practices to be followed by candidates, political parties, and coalitions. More specifically, the guide addresses topics such as the processing of sensitive personal data, considerations around the appropriate use of data to avoid misuse, and individuals' rights such as the right to informative self-determination under the LGPD, among other things.
