Brazil: ANPD appoints first DPO and creates Working Group

The Brazilian data protection authority ('ANPD') published, on 9 April 2021, Ordinance No. 28 of 8 April 2021, appointing its own first data protection officer ('DPO'), Thiago Guimarães Moraes, as well as his substitute, Tatiana Freitas de Oliveira. Moreover, the ANPD created the Working Group with the purpose of formulating guidelines, proposing actions, and monitoring measures aimed at adapting the ANPD to the Law No. 13.709 of 14 August 2018, General Personal Data Protection Law (as amended by Law No. 13.853 of 8 July 2019) ('LGPD'). In particular, the ANPD announced that the Working Group will have the following functions:

  • prepare and submit the Privacy Governance Program;
  • coordinate compliance with the LGPD and the ANPD policies regarding the protection of personal data; and
  • provide guidance, when requested, with respect to data protection impact reports relating to ANPD's personal data processing activities.
