Thailand: PDPC publishes forms for the requirement to appoint DPOs

On December 6, 2023, the Personal Data Protection Committee (PDPC) published two forms in relation to its previous notification regarding the requirement to appoint personal data protection officers (DPO) where personal data processing constitutes regular monitoring of the personal data or the system, in accordance with Section 41(2) of the Personal Data Protection Act 2019 (PDPA). The PDPC recalled that the notification to appoint DPOs was to take effect 90 days from its publication in the Royal Gazette, namely on December 13, 2023. Therefore, to assist those unsure if they fall under the requirement, the PDPC provided two forms for download:

  • a form for notifying information about DPOs; and
  • an evaluation form for the provision of DPOs according to Section 41 of the PDPA.
