Lao PDR: MIC publishes draft Electronic Commerce Decree

The Ministry of Industry and Commerce ('MIC') of the Lao PDR published, on 2 January 2020, an initial draft on the first Electronic Commerce Decree ('the Draft Decree') dealing with online commerce within regional and international trade. In particular, Article 30 of the Draft Decree establishes a general protection of personal information in e-commerce activities and the requirement of valid consent for data collection or the use of personal information. Furthermore, the Draft Decree establishes the need to comply with the Data Protection Law Act ('the Act') of Lao PDR. Lastly, the Draft Decree stipulates that violations of the Act may lead to fines, civil or criminal penalties. 

In addition, the MIC noted that the Draft Decree is open for consultation and comments may be submitted to the Department of Foreign Trade Policy by entities, organisations and individuals until 26 January 2020.
