Wisconsin: Bill on disclosures regarding AI generated content in political advertisements passes first reading in Senate

On February 19, 2024, Senate Bill 644 relating to disclosure regarding content generated by artificial intelligence in political advertisements passed the first reading before the Wisconsin State Senate.

The bill seeks to require that any audio or video communications in political advertisements disclose if the communication contains synthetic media. The bill defines synthetic media as 'audio or video content that is substantially produced in whole or in part by means of generative artificial intelligence.'

The bill provides that every video communication must indicate if the video, audio, or both video and audio content is artificial intelligence (AI) generated. Specifically, with the wordings:

  • 'This video content generated by AI' if the video includes video synthetic media only;
  • 'This audio content generated by AI' if the video includes audio synthetic media only; or
  • 'This content generated by AI' if the video includes both video and audio synthetic media.

Moreover, the bill would impose a penalty of up to $1,000 for each violation of the bill and authorize the Ethics Commission to outline exceptions to the aforementioned requirements.
