Tanzania: Data protection regulations published following PDPA entry into force
On July 9, 2023, OneTrust DataGuidance Research confirmed with Rachel Magege, Lawyer and Project Associate at Pollicy, that, on May 12, 2023, the Data Protection (Personal Data Collection and Processing) Regulations, 2023 and the Data Protection (Complaints Settlement Procedures) Regulations, 2023, were published by the Ministry of Information, Communication, and Information Technology. The publication of the Regulations follows the entry into force of the Personal Data Protection Act 2022 (PDPA) on May 1, 2023.
The Collection and Processing of Personal Data Regulations lay down provisions regarding, among other things:
- registration with the Personal Data Protection Commission (PDPC);
- data subjects' rights;
- data controllers' and data processors' responsibilities; and
- cross-border data transfers.
The Complaints Handling Procedure Regulations regulate the submission of complaints by data subjects, as well as the PDPC investigation and resolution procedures.
