Switzerland: FDPIC releases factsheet on investigations of data protection violations

On July 18, 2023, the Federal Data Protection and Information Commissioner (FDPIC) released a factsheet providing an overview of its investigations into violations of data protection regulations. In particular, the factsheet summarizes the in-depth interpretations of Articles 49 to 53 of the revised Federal Act on Data Protection (FADP), which comes into force on September 1, 2023.

Moreover, the factsheet provides that the FDPIC, as the supervisory authority, is responsible for ensuring compliance with the FADP and other federal data protection regulations by both federal bodies and private individuals, per Article 4(1) of the FADP. In this regard, one of the FDPIC's key tasks is to conduct investigations into potential breaches of data protection regulations, as outlined in Article 49 of the FADP, and, where necessary, impose administrative measures to enforce these regulations, pursuant to Article 51 of the FADP.
