South Africa: Regulator publishes report on investigations relating to POPIA and PAIA for 2022-2023
The Information Regulator ('the Regulator') announced, on 5 April 2023, that it had published a report on the outcomes of complaints investigated in relation to the Protection of Personal Information Act, 2013 (Act 4 of 2013) ('POPIA') and Promotion of Access to Information Act 2 of 2000 ('PAIA').
In particular, the report outlines the process for complaints' investigation, highlighting that, as far as POPIA is concerned, the Regulator can investigate a complaint submitted by any person or it can, on its own initiative, investigate a complaint. However, the report explains that, in regards to PAIA, the Regulator can only investigate a complaint submitted by a requester of information or a third party. Furthermore, the report specifies that, for the financial year 2022-2023, the PAIA Division of the Regulator received over 309 complaints and, of these, 209 were resolved. In contrast, the report states that the POPIA Division received 895 complaints during the reporting period and 616 of these were resolved.
