Saxony: State Government approves draft Transparency Act for consultation
The Saxon State Government announced, on 31 August 2021, that it had approved the draft Saxon Transparency Act, for consultation, drawn up by the Saxon State Ministry of Justice and for Democracy, European Affairs and Equality. In particular, the draft Act provides, among other things, for a right to the publication of information such as government resolutions, draft laws, studies, and reports, which are to be made available by the public administration on an online platform specifically set up for this purpose. Moreover, the draft Act is to apply to the State Government and to the entire public administration of Saxony with an exception for municipalities and counties and, in certain instances, to parts of the so-called indirect State administration, such as the medical association and the bar association.
Democracy Minister Katja Meier noted, "[…] [W]e want to create a right for all citizens to have access to information about government actions. In doing so, we are initiating a cultural change in the actions of public administration toward greater transparency. The Transparency Act strengthens trust in the rule of law and democracy, and contributes to greater citizen participation."
Notably, the draft Act pursues an approach of providing information as extensively and comprehensively as possible, while also providing for exceptions, including for reasons of public security and in case of sensitive data relating to individuals.
