Oklahoma: Bill on use of AI by state government referred to Senate Committee

On April 4, 2024, House Bill 3828 on the use of artificial intelligence (AI) by the State government, was recommended to pass as amended by the Senate General Government Committee and referred to the Appropriations Committee on the same date. The bill was read for the first time in the House of Representatives on February 5, 2024, and was thereafter signed by the House of Representatives and sent to the Senate on March 18, 2024. 

In particular, the bill defines 'artificial intelligence' and is applicable to every 'state agency,' which it defines as a 'department, board, council, commission, institution, or other agency of the executive branch of the state government.'

The bill outlines that:  

  • by December 31, 2024, an inventory must be carried out of all systems deploying AI;
  • as of February 1, 2025, an ongoing assessment of systems deploying AI shall be performed;
  • by February 1, 2025, the Office of Management and Enterprise Services shall develop and establish policies and procedures concerning the development, procurement, implementation, utilization, and ongoing assessment of systems deploying AI; and
  • as of February 1, 2025, no state agency shall implement any system that employs AI unless it has performed an impact assessment or if it is determined that such system will result in unlawful discrimination or disparate impact.

If enacted, the bill will come into effect on November 1, 2024.
