New York: Bill on age verification on social media platforms referred to Internet and Technology Committee

On January 3, 2024, Senate Bill 6418 for an act to amend the general business law and executive law, in relation to the regulation of social media companies and social media platforms was referred to the Internet and Technology Committee.

In particular, the bill provides that social media companies may not permit a New York resident who is a minor to hold or open an account on a social media platform if the minor is ineligible to hold or open an account under any other provision of state or federal law. The bill establishes that social media companies must verify the age of an existing or New York State account holder. Moreover, the bill clarifies that where the New York State account holder fails to meet the age verification methods, the social media company must deny access to the account upon expiration of the required time period and until all age verification requirements are met.
