Montenegro: AZLP addresses lack of response from public authorities regarding requests to access information

The Agency for Personal Data Protection and Free Access to Information ('AZLP') announced, on 15 October 2021, that it had performed an analysis of complaints regarding failure of public authorities to act on access to information requests. In particular, the AZLP stated that it had previously sent letters in such cases to the relevant public authorities ordering the issuance of a response to access requests and noted that despite this, public authorities had continued to be unresponsive towards such requests. Furthermore, the AZLP stated that it has submitted an initiative for initiating misdemeanour proceedings in cases where non-compliance with its orders continues in accordance with Articles 2, 5, 6, and 47 of the Personal Data Protection Law 79/08 and 70/09 ('PDPL').

Moreover, the AZLP highlighted that the fines associated with non-compliance of the legal entity and the responsible person within the legal entity, will range from €500 to €20,000 for the former, and €200 to €2000 for the latter, noting that this is to reduce the trend of inactivity of public authorities and achieve greater transparency.
