Israel: Ministry of Justice introduces bill amending law on class action to include privacy violations

On May 2, 2024, the Privacy Protection Authority (PPA) announced, via LinkedIn, that the Ministry of Justice had introduced the bill on Class Actions (Amendment No. 16), 2024 for public comments. The PPA highlighted that the bill aims to promote proper and well-founded class actions, including claims for invasion of privacy.

What are the key proposals of the bill?

The bill proposes that it will be possible to file a class action on the grounds of violation of privacy under Section 2 of the Protection of Privacy Law, 5741-1981 (PPL), for example:

  • for use of information about a person's private affairs contrary to the purpose for which it was provided;
  • use of personal information contrary to the purposes of the database in which the information is held;
  • for breach of the duty to inform when contacting a person for information about them; or
  • for violation of the Data Security Regulations that causes a serious security incident, in relation to a substantial part of the database or in relation to information about more than 1,000 data subjects.
