India: MeitY issues advisory on deepfakes
On December 26, 2023, the Press Information Bureau (PIB) announced that the Ministry of Electronics and Information Technology (MeitY) issued an advisory to intermediaries on misinformation powered by artificial intelligence (AI) deepfakes. More specifically, the MeitY advises intermediaries to comply with the existing Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules).
The PIB stated that the advisory requires, among other things, that the intermediaries communicate prohibited content, particularly those specified under Rule 3(1)(b) of the IT Rules, clearly and precisely to users through its terms of service and user agreements, and the same must be expressly informed to users at the time of first-registration and also as regular reminders. Specifically, the PIB provided that such content must be provided at every instance of login and while uploading/sharing information onto the platform. The PIB further stated that Rule 3(1)(b) of the IT Rules aims to ensure platforms identify and promptly remove misinformation, false or misleading content, and material impersonating others, including deepfakes.
