Georgia: PDPS publishes paper on data protection of minors
On January 30, 2024, the Personal Data Protection Service (PDPS) published a paper on data protection of minors, addressing the specific vulnerabilities of children.
Which topics are discussed in the paper?
In particular, the paper discusses the national and international legislative frameworks for minors' personal data protection, namely aspects relating to principles of data processing, consent, children's data protection rights, and data transfers, as well as international legal instruments and practices, in particular, the protection of minors' right to privacy.
The paper highlighted that the person responsible for the processing can implement appropriate age verification mechanisms for processing operations based on consent. The paper further noted that the age verification mechanism should not lead to data loss or excessive processing of data.
The paper also outlined that the law establishes the obligation of the processor to take into account all reasonable measures to confirm the consent of the parent or legal representative for processing data of minors under the age of 16.
Moreover, the paper noted that the obligation to provide information to minors regarding the processing of their data must be done in a form that is understandable to the minors.
