Gabon: CNPDCP issues statement clarifying Data Protection Law

The National Commission for the Protection of Personal Data ('CNPDCP') issued, on 30 January 2019, a statement ('the Statement') clarifying its competency as well as provisions of Law No. 001/2011 on the Protection of Personal Data ('the Data Protection Law'). In particular, the Statement outlines that the CNPDCP can impose fines ranging from CFA 1 million (approx. €1,530) to CFA 100 million (approx. €152,960) for violations of the Data Protection Law, CFA 100 million to CFA 300 million (approx. €458,875) for repeated violations, as well as issue warnings and a three-month ban on activities. Moreover, the Statement notes that sensitive personal data, such as political opinions or activities, health or religiously sensitive data, should neither be collected nor processed without the data subject's consent.
