Canada: OPC provides submission on implementing protocol to convention on cybercrime

On April 23, 2024, the Office of the Privacy Commissioner of Canada (OPC) announced that it had provided its submission to Justice Canada on Consultation on the Second Additional Protocol to the Convention on Cybercrime on Enhanced Co-operation and Disclosure of Electronic Evidence. Broadly, the OPC stated that it recommended options for stronger oversight, safeguards, and transparency.

More specifically, the OPC provided its feedback on the following sections:

  • direct requests by law enforcement or other competent authorities;
  • ordering disclosures of subscriber and traffic data;
  • safeguards, data protection, transparency, and oversight; and
  • questions for privacy commissioners on powers and interoperability.
