In this Jurisdiction Overview video, we outline California privacy laws including the CCPA, CPRA, and sectoral laws, highlight some of their key requirements, as well as taking a brief look at the background of the key privacy laws in the state.
California Privacy
The CCPA was the first comprehensive privacy law in the US and it marked the dawning of a new age for privacy in California and the US more broadly. The CCPA introduced new requirements for covered businesses to meet as well as offering several new rights for consumers as to how their personal information is handled. In November 2020, the California privacy landscape changed due to the passing of the CPRA, which added further obligations for businesses that sell or share personal information as well as additional rights for consumers.
There are also several sectoral laws that have an impact on privacy in California, notably a data breach notification statute, the California Online Privacy Protection Act (‘CalOPPA’), and the California Invasion of Privacy Act.
