New Release | Data Subject Rights Comparison Chart
OneTrust DataGuidance is pleased to announce the release of its Data Subject Rights Comparison, which provides an in-depth analysis of the data subject rights provided for in privacy legislation around the world.
The Data Subject Rights Comparison enables identification of which rights are supported in which jurisdiction and the supporting Guidance Notes provide detail regarding the grounds for such rights as well as the requirements for exercising these rights. It is now possible to compare where there are rights of information, access, rectification, erasure, restriction of processing, portability, and rights related to automated decision-making, and to review identity verification, format, timeframe, and fee requirements, as well as the legal bases and exceptions for applying these rights. In addition, the Guidance Notes clarify key additional information such as representatives for children's rights and obligations to collaborate with third parties.
Users can now:
- Compare where rights are established
- Analyze the legal grounds for requesting or refusing data subject rights
- Consider procedures such as whether fees can be charged, the format of rights requests and responses, and the timeframes for exercising rights
- Examine the specific requirements and procedures for different rights within a jurisdiction
- Review additional obligations including record-keeping, collaboration, penalties, and the use of representatives
