Yukon: Commissioner issues report on Yukon Hospital Corporation data disclosure complaint

The Yukon Information and Privacy Commissioner ('the Commissioner'), Diane McLeod-McKay, announced, on 15 January 2019, that she had issued a Consideration Report ('the Report') regarding a complaint from an individual that the Yukon Hospital Corporation had disclosed records containing her and her child's personal health information to state authorities without her consent, contrary to the Health Information Privacy and Management Act 2016 ('HIPMA'). In particular, the Commissioner determined that while the Yukon Hospital Corporation had authority to disclose the health information without consent, it had failed to make the individual aware that her information would be disclosed, which denied her the opportunity to refuse her consent.

The Commissioner issued four recommendations to Yukon Hospital Corporation, including that it adopt the practice of informing people about this type of disclosure so they may exercise their right of refusal; that it review its practice of disclosing health information as mandated by the Yukon Government Department of Health and Social Services to ensure it does not contravene HIPMA; and that it should take steps to recover or destroy the personal health information disclosed.
