Virginia: House passes tax return data breach notification bill

The Virginia House of Delegates passed, on 28 February 2018, the bill to introduce An Act to Amend the Code of Virginia by Adding a Section Numbered 58.1-341.2, Relating to Notification of Tax Return Data Breach (SB 271) ('the Bill').

The Bill, which was passed by the Virginia Senate on 22 January 2018, would require paid income tax return preparers to notify the Department of Taxation within a reasonable time period if they discover that an unauthorised person has accessed and acquired a taxpayer's unencrypted or unredacted return information. The Bill also provides a definition of return information and provides that it does not include publicly available information.
