Vietnam: MPS issues Decree on Electronic Identification and Authentication

The Ministry of the Public Security ('MPS') issued, on 5 September 2022, Decree 59/2022/ND-CP on Electronic Identification and Authentication. In particular, the Decree applies to Vietnamese agencies, organisations, and citizens, as well as foreign organisations and individuals residing in Vietnam and operating in Vietnam relating to electronic identification and authentication. More specifically, the Decree outlines the electronic identity of Vietnamese citizens and foreign citizens includes different types of information. Notably, the Decree provides that electronic information includes personal information number, full name, date of birth, gender, and biometric information, while that of foreign citizens also includes passport information.

Furthermore, the Decree governs the use of VNeID, an application on digital services created by the MPS for electronic identification and authentication procedures, alongside the methods for citizens and foreigners using electronic services to activate and use their VNeID. In addition, the Decree provides that information about electronic identification is permanently stored in an electronic identification and authentication system, while historical information on the use of an electronic identification account is stored for a period of five years from the time of using the account.

Finally, the Decree outlines conditions for organisations providing electronic authentication services, in order for organisations to be granted a certificate of eligibility for electronic authentication services by the MPS. Notably, the Decree's conditions include, among other things, conditions on personnel qualifications and citizenship, technical conditions on information security systems and storage plans, and information of the machinery and equipment currently owned in Vietnam.

The Decree enters into effect on 20 October 2022.
