Victoria: OVIC commences investigation into alleged surveillance by VicForests

The Office of the Victorian Information Commissioner ('OVIC') announced, on 12 May 2022, that it had commenced an investigation into allegations of improper surveillance by VicForests in 2011. In particular, the OVIC highlighted that the investigation will examine whether VicForests contravened the Information Privacy Principles in the Privacy and Data Protection Act 2014 ('the PDP Act'). Furthermore, the OVIC stated that, in addition to considering the historical allegations from 2011, the OVIC will examine any current practices and procedures by VicForests for conducting surveillance for consistency with the PDP Act. Finally, the OVIC confirmed that, in accordance with its Regulatory Action Policy, investigations are conducted in private and, as such, this means that the OVIC will not provide any further comment on the investigation while it is being carried out.
