Venezuela: CONATEL announces publication of decree on protection of telecommunication services users' rights

The National Telecommunications Commission ('CONATEL') announced, on 7 January 2019, that Decree No. 3.691 on the Regulation for the Protection of the Rights of Users in the Provision of Telecommunications Services ('the Regulation') was published, on 27 November 2018, in the Official Gazette. In particular, the Regulation requires that telecommunication operators establish mechanisms to safeguard the secrecy and inviolability of private communications on their networks, as well as adopt mechanisms that guarantee the confidentiality of personal data of their subscribers throughout the provision of telecommunication services. In addition, the Regulation provides that personal data may not be used for the development of databases for commercial or advertising purposes without the express and written authorisation of the subscriber.
