Utah: Bill on Social Media Regulation Amendments signed by Governor

On March 13, 2024, Senate Bill 194 for the Social Media Regulation Amendments was signed by the Governor of Utah. This follows its introduction to the Utah State Senate on February 5, 2024. In particular, the bill makes amendments to the Utah Minor Protection in Social Media Act.

More specifically, the bill outlines requirements for social media companies to implement age verification systems, parental controls on accounts held by Utah minors, and principles including privacy by default. Regarding age verification, social media companies must:

  • implement a review process allowing account holders to appeal their age designation by submitting documentary evidence to establish the account holder's age range; and
  • review evidence submitted by the account holder and make a determination within 30 days of submission of the evidence.

For minor account holders, social media companies must:

  • set default privacy settings to prioritize maximum privacy;
  • implement and maintain reasonable security measures to protect the confidentiality, security, and integrity of personal information collected from a minor's account;
  • provide an easily accessible and understandable notice; and
  • disable features that prolong user engagement.

The bill enters into effect on October 1, 2024.
