USA: White House publishes statement of administration policy on Fourth Amendment Is Not For Sale Act

On April 16, 2024, the White House Office of Management and Budget (OMB) published a statement of administration policy for House Resolution 4639 for the Fourth Amendment Is Not For Sale Act (HR 4639). In particular, the White House highlighted its opposition to HR 4639, providing that it would generally prohibit the intelligence community and law enforcement from obtaining certain commercially available information, subject to narrow exceptions. In addition, the White House provided that HR 4639 would not affect the ability of foreign adversaries or the private sector to obtain and use the same commercially available information. Specifically, the White House noted that access to commercially available information is necessary for detecting and responding to cyberattacks.

The White House instead stipulated that it has taken steps to address privacy concerns stemming from commercially available information, such as through the Executive Order on Access to Americans' Bulk Sensitive Personal Data and United States Government-Related Data by Countries of Concern.
