USA: EPIC issues statement on draft adequacy decision for EU-US data flows

The Electronic Privacy Information Center ('EPIC') issued, on 13 December 2022, a statement on the draft adequacy decision for the EU-US Data Privacy Framework. In particular, EPIC highlighted that the European Commission found that the EU-US DPF, along with the Executive Order on Enhancing Safeguards for United States Signals Intelligence Activities ('the Executive Order') and the U.S. Department of Justice's regulations, guarantees essentially equivalent protections to those in the EU, paving the way for its adoption by EU Member States. To this end, EPIC noted that it has supported calls for enhanced privacy protections prior to the establishment of the new data transfer framework, stating that it had recently commented on the Executive Order, outlining several areas of concern ahead of a likely challenge at the Court of Justice of the European Union.
