UK: ICO announces adequate data protection for Guernsey's law enforcement processing

On July 7, 2023, the Information Commissioner's Office (ICO) announced on LinkedIn that the UK Home Office has concluded that Guernsey provides an adequate level of data protection for law enforcement processing. In particular, the assessment of adequacy for the Bailiwick of Guernsey will enable the free flow of personal data for law enforcement purposes between the UK and Guernsey, starting from July 28, 2023. The ICO noted that it provided advice to the Home Office throughout the assessment process and has now published its opinion, offering independent assurance that the assessment was conducted appropriately, leading to a reasonable conclusion. This development aligns with the ICO's objective of enabling international data flows through regulatory certainty.
