Thailand: MDES publishes statement on mass media exemption from compliance with the PDPA

The Ministry of Digital Economy and Society ('MDES') published, on 7 June 2022, a statement on the exemption of mass media businesses from compliance with the Personal Data Protection Act 2019 ('PDPA'). In particular, the MDES clarified that mass media businesses are exempt through Article 4(3) of the PDPA whereby the PDPA does not apply to the activities of mass media, fine arts, or literature, which are only in accordance with professional ethics or for the public interest. Therefore, the MDES noted that the media may take pictures, record clips, and distribute them without blurring or obtaining consent; however, this must be in accordance with the code of professional ethics or in the public interest.
