Thailand: Draft secondary laws under Digital Platforms Decree issued for public consultation

On June 21, 2023, the Ministry of Digital Economy and Society (MDES) issued a press release on the legislative initiatives under the Royal Decree on Digital Platform Service Businesses that Require Notification, B.E. 2565, which was published on December 2022 in the Government Gazette and will enter into force on August 21, 2023. In particular, the MDES noted that the Electronic Transactions Development Agency (ETDA) held four public hearing meetings on draft secondary laws under the Royal Decree. Among other things, the ETDA issued draft guidelines on the methods for identifying active users to assist digital service operators in understanding calculation methods and proposed to narrow down the definition of 'users' for measuring annual monthly active users to include solely Thai people.
