Texas: Amendments to breach notification law signed by Governor and becomes law

On May 27, 2023, Senate Bill 768 on breach notification was signed by the Texas Governor and will enter into effect on September 1, 2023. The bill amends the state's data breach notification laws under the Texas Business and Commerce Code by requiring notification to the Attorney General (AG) as soon as practicable, but no later than 30 days after the date on which the person determines that the breach occurred if the breach involves at least 250 residents in Texas. In addition, the bill establishes that notification must be submitted electronically using a form accessed through the AG's internet website.
