Switzerland: Federal Office of Justice publishes FAQ on data protection

The Federal Office of Justice published, on 16 February 2023, frequently asked questions ('FAQ') on data protection. In particular, the FAQ provides information on the revised Federal Act on Data Protection ('the revised FADP'), particularly noting that with its decision, the Federal Council put the revised FADP and the corresponding implementation provisions in the revised Ordinance on the Federal Act on Data Protection and the new Ordinance on Data Protection Certifications into force on 1 September 2023.

On the question of evaluating on international developments in data protection, the FAQ highlights that Switzerland has had an EU adequacy decision since 2000, which recognises an equivalent level of data protection and the revised FADP enables the Swiss level of protection to be brought closer to the EU standards.
