Spain: Ministry of Justice publishes draft law to transpose Whistleblowing Directive

The Ministry of Justice published, on 8 March 2022, the preliminary draft law regulating the protection of people who report regulatory infractions and the fight against corruption, transposing the Directive on the Protection of Persons who Report Breaches of Union Law (Directive (EU) 2019/1937) ('the Whistleblowing Directive'). In particular, the Ministry of Justice published the draft law for submissions, which closed on 17 March 2022.

Moreover, the draft law is intended to protect individuals who report corruption or fraud and violations of EU law and the internal legal system, by establishing protected communication channels and prohibiting any retaliation against them. In addition, the Ministry of Justice noted, on 4 March 2022, that the Council of Ministers had approved the draft law.
