Spain: AEPD fines Solo Embrague €1,800 for GDPR and Information Society Law violations

The Spanish data protection authority ('AEPD') issued, on 3 March 2020, a resolution ('the Resolution') on proceeding No. PS/00469/2019 fining Solo Embrague SL €1,800 for violations of Article 13 of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'), and Article 22(2) of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce ('the Information Society Law'). In particular, the Resolution highlights that the individual complainant argued that Solo Embrague's website did not present, in its initial page, a privacy policy or a cookie banner redirecting to the cookie policy. As a consequence, the Resolution imposes on Solo Embrague a fine of €3,000, reduced to €1,800 due to the voluntary payment of Solo Embrague.
