Spain: AEPD fines Fusiona Soluciones Energeticas €50,000 for processing without a legal basis

On May 17, 2023, the Spanish data protection authority (AEPD) published its decision in Proceeding No. PS-00586-2023, in which it imposed a fine of €50,000 on Fusiona Soluciones Energeticas SA, for violation of Article 6(1) of the General Data Protection Regulation (GDPR), following a complaint submitted by an individual.

Background to the decision

In particular, the AEPD noted that Fusiona Soluciones Energeticas had included the complainant's personal data in a credit information system in relation to a debt associated with a contract they did not enter into.

Findings of the AEPD

Following its investigation, the AEPD held that Fusiona Soluciones Energeticas violated Article 6(1) of the GDPR by processing the complainant's data without a legitimate basis.

Outcomes

In light of the above, the AEPD imposed the abovementioned fine on Fusiona Soluciones Energeticas.
