South Africa: Regulator enforcement powers under POPIA come into effect 

The Information Regulator announced, on 1 July 2021, that its enforcement powers under the Protection of Personal Information Act, 2013 ('POPIA') has into effect from this date following the conclusion of the 12 month transition period for compliance as provided under Section 110 of POPIA. In particular, the President announced, on 22 June 2020, that Sections 110 and 114(4) of POPIA, pertaining to the amendments of related laws and the transfer of functions regarding the Promotion of Access to Information Act, 2000 ('PAIA') from the South African Human Rights Commission to the Regulator, will commence on a later date of 30 June 2021. As a result, organisations must comply with its provisions by 1 July 2021.
